An ever-increasing number of states have passed legislation for the legalization of marijuana for medical uses and some states have even legalized the herb's recreational use. State laws determine who may cultivate or sell marijuana and under what conditions they may do so. At the outset, it should be noted that the cultivation and sale of marijuana are still considered federal crimes, and whatever efforts are made to comply with state and local laws will not prevent you from being prosecuted under federal law. Regardless, those starting a marijuana business can avoid most serious problems by closely following state and local rules.
The Bill also establishes a 9-member Medical Cannabis Production Commission (the “Commission”)(Who are the 9 members?) with the power to establish the medical cannabis supply system with distribution to occur through medical cannabis centers. The Commission will be tasked to “establish a system that is well regulated, includes a seed-to-sale tracking system, and is financially viable for suppliers to ensure the highest quality cannabis and cannabis-infused products for patients.” Under the Bill, the will evaluate supplier license applications and submit a list of 20 applications to the Commission for approval.
As you may imagine, the licensing documentation, processes, and requirements during and after licensing are quite detailed.
